Consumer Health Data Privacy Notice (for WA and NV residents)

This Consumer Health Data Privacy Notice (the “Notice”) supplements the Henkel North America Privacy Policy and applies to Personal Information of residents of Washington and Nevada that is defined as “consumer health data” under applicable Washington and Nevada law.

1. Health Data We Collect  

We may collect certain health-related data (“health data”) from you when you communicate with us to submit a request or complaint related to your health.  Health data may include: 

  • Health conditions, treatment, diseases, or diagnoses
  • Health-related procedures
  • Use or purchase of medication 
  • Measurements of bodily functions, vital signs, or characteristics; or
  • Other health-related information you provide in your communications with us.

2. How We Use Health Data

We collect and use your health data to respond to your request or address your complaint, to maintain the safety of our products as may relate to your request, to comply with legal requirements or requests from government bodies, and to establish, exercise, or defend actual or potential legal claims.

3. Sharing of Health Data

We may use service providers to collect or process your health data on our behalf, and thus share each category of your health data described above.  Sharing of health data may also occur in the context of complying with legal requirements, government requests, or legal claims.  

4. Your Rights

Subject to applicable law, you may have the following rights related to your health data: 

  • A right to request access to your health data.
  • A right to request deletion of your health data.

Please note, as permitted or required under applicable law, we take steps to verify your request before we can process your request.  If we believe we need further information to verify your request, we may ask you to provide additional information to us.

If your rights request is denied, applicable law may give you a right to lodge an appeal with us.  The response to your rights request will inform you of any appeal rights you may have and tell you how you can exercise them.

Updates to this Notice.  If we change this Notice, we will post the revised version here and change the effective date (the date it applies from). You should check here regularly for the most up-to-date version of the Notice.
